Introduction to EB-3 Visa:

The EB-3 visa is a green card for un-skilled workers or workers. There are three ways to qualify:

● Skilled workers need at least 2 years of experience and labor certification.

● Professionals.

● Unskilled/other workers.

The time for an EB-3 visa can vary depending on your country of origin, ranging from 1 to 2.5 years. The PERM labor certification process takes approximately 6 to 9 months.
The EB-3 visa leads to a green card, granting lawful permanent resident status. Green cards typically have an initial validity of 10 years. EB-3 visa holders can apply for green card renewal or extension as their initial 10-year green card approaches expiration. It’s important to start the renewal or extension process in advance.

You must provide the following paperwork with your EB3 visa application.

● A passport that is valid for travel abroad for at least six months.

● Two passport-sized photos that meet the requirements for U.S. visas.

● Completed Form I-140 and, if necessary, Form I-907

● Form I-140 and, if necessary, Form I-907 payment receipt

● Birth certificate; government-issued identity, such as a driver’s license; U.S. Department of labor certification; and work offer from an employer.

● Academic credentials documents

● Tax payment records

● There may be other case-specific papers that you must submit.

● Must be capable and willing.

Skilled Workers:

● Must have at least 2 years of work or training experience.

● Relevant post-secondary education can be considered as training.

● Must work in a role where qualified U.S. workers are unavailable.

Professionals:

● Must perform a job that no skilled U.S. worker is available for.

● Must have job experience in the professional field.

● Requires a U.S. bachelor’s degree or foreign equivalent. Labor Certification:

● The employer will provide a labor certification (Form ETA-9089) from the Department of Labor.

● It demonstrates that he is needing to fulfill this job allocation and haven’t found a U.S. worker available for the position.

Application Process:

● Employers file Form I-140, Immigrant Petition for Alien Workers, on behalf of the applicant.

● Premium processing charges an additional fee.

● Skilled professionals and unskilled workers require a full-time, permanent job offer. Family of EB-3 Visa Holders:

● Spouses and unmarried children under 21 may apply for admission to the U.S.

● Spouses and children will obtain the Green Card, through your application.
